Terms & Conditions

In the terms

Goods means window furnishings or other goods supplied by QB Blinds and the subject of the order made by 'you' meaning the person ordering the goods.  

1.  Our Contract

Our e-commerce website invites you to buy goods from QB Blinds.  A binding contract with you will only arise once QB Blinds has recieved payment for the goods in full from you and has notified you of acceptance of your order by e-mail to the e-mail address given by you in the order.

2.  Price

2.1       The price for any goods ordered by you will be the price given to you from our website system and confirmed in the confirmation generated after you place your order and to the e-mail address supplied by you.  Prices will include all taxes applicable in the UK and delivery costs within the UK mainland.

2.2       In addition to the price a delivery charge may be payable for goods outside the UK mainland.

2.3       Subject to clause 4 we will debit the price plus any applicable delivery charge from your debit/credit card on receiving your order or as soon as reasonably practicable.

3.    Rights of Cancellation

3.1       You may cancel orders within 12 hours only of your order (our warehouse aims to despatch within 12 hours of order placement)

3.2       You cannot change or cancel your order beyond the 12 hours or order placement

3.3       If you cancel your order within 12 hours we will re credit any sum debited to us from your debit/credit card as soon as possible.

4.    Stock Shortages

4.1       If goods are unavailable QB will notify you as soon as possible and cancel your order.  We will re credit any sum debited to us as soon as possible.  We will inform you of a new date for stock availability or suggest an alternative product.

5.    Product Variations

5.1      Whilst every attempt is made to ensure goods sold and delivered match in every respect the descriptions and photo's on our website, any minor or immaterial variations or alterations shall not entitle you to reject the goods nor to claim any compensation for such variation.  Many of our products are manufactured from natural products and as such are characterised by their susceptibility to subtle changes in texture or colour.

6.    Delivery of your goods

6.1     QB will deliver goods to the address supplied as soon as is possible.

6.2       Ownership of and risk in the goods will pass to you when delivered and signed for by you.  IT IS IMPORTANT THAT YOU DO NOT SIGN FOR GOODS DAMAGED IN TRANSIT.  If you sign for goods damaged  we cannot entertain any responsibility for the goods or accept return.  YOU MAY SIGN FOR GOODS "AS DAMAGED" and inform us immediately of any damage if occured to the goods contained within the package.  Please note that on occasions a damaged or dented package may well (as intended) contain perfect goods.

7.    Defective Goods

7.1       QB warrants all goods sold to you will be free of defects for 12 months from delivery.

7.2       If a defect is discovered or occurs within 12 months of delivery you must contact us by e-mail describing the defect.  We will then arrange a carrier to collect the goods as soon as is practicable and:-

7.3       Either replace of repair the goods and return to you free of charge or:-

7.4       If  goods returned are not defective or have been subjected to misuse or negligence or have been modified then we will not credit your debit/credit card but contact you by e-mail to return the goods to you in current state or suggest cost of repair/replacement.

7.5       If the goods are defective on delivery (QB must be notified within 72 hours of receipt), we will arrange for full credit within 30days to your debit/credit card and collection of the goods.

7.6       Except where you are a consumer all other warranties and terms relating to firness for purpose satisfying quality or conditions of goods  whether implied by statute or common law are otherwise excluded to the fullest extent of the law.

 

 8.    Use of Goods

8.1       By placing an order you are authorising QB at its descretion to carry out a credit reference or enquiry upon your financial status.  We reserve the right to choose not to supply at  our discretion.

 9.    Responsibilities

9.1       No statement, description, recommendation contained in the website, advertisement or communication shall be interpreted to enlarge, vary or overide in any way the terms.

 

 10.    Events beyond our control

10.1      We shall have no liability to you for any failure to deliver ordered goods for any delay caused by events or circumstance beyond our control, including strikes, disputes, system breakdown, network access, flood, fire, explosion or accident.

 

11.     Enforceability

11.1     If any part of these terms and conditions is unenforceable the enforceability of any other part of these terms and conditions will not be affected.

 

12.    Data Protection

12.1      We will respect your right to privacy as laid out in the Data Protection Act 1998.

 

13.    Third Party Rights

13.1      Except for as affiliates, directors, employees a person who is not a party to this agreement has no right under the UK contracts (Right of Third Parties) Act 1999 to enforce any terms of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from the act.

14.    Governing Law

14.1      This contact is subject to English Law and the exclusive jurisdiction of the English Courts.
